The state of Colorado accepts uncontested divorces. For spouses in certain situations, Colorado offers an expedited process for divorce, defined under state law as a dissolution upon affidavit. This means that, rather than appearing in court, both parties can simply sign a legal document to complete the divorce.
This option is only available to Colorado residents who either have no lasting ties, such as shared property or minor children, or have drawn up agreed-upon resolutions for dividing assets and custody schedules. Both parties must also agree that the marriage is unsalvageable. The affidavit must be filed by both parties or served legally through the county sheriff. While a successful dissolution upon affidavit negates the need for a court hearing, both parties should still contact lawyers, especially while drafting any separation agreements.
